    1. I, Anil Malhotra, Advocate, hereby serve upon you a legal notice under the Consumer Protection Act, 1986 for deficiency of service, unfair trade practices and monopolistic schemes to dupe and cheat customers by attractive schemes to buy JSB Wellness Foot Massagers and then not provide any service backup or repair center facilities at any physical premises in tricity of Chandigarh, Mohali and Panchkula.

    2. I had contacted Mr. Vinod on 3 October on phone no. 93545-74148 in respect of servicing of a HF05 Ultra Foot Massager from your Sector 17 outlet in Chandigarh which has now since been closed and there is no other outlet in Chandigarh.

    3. A written response was given by Mr. Vinod to contact Sawhney Fitness Equipments, SCO 13-14 Level 2 inside market, above Dominos Sector 22-C, Chandigarh 160022. Mob. 9702161733 after Mr. Vinod asked for my complete address with Pincode. Mr. Vinod informed me that technician visit and service charges are Rs. 750 plus if any spare part has to be replaced, then the cost of that.

    4. Mr. Vinod confirmed that there is no physical outlet of company in Panchkula, Mohali or Chandigarh.

    5. That upon contacting mobile no. 97021-61733, Mr. Sudhakar answered from Mumbai from NOORSPEE Company saying that Mr. Arvind will contact me. I just got a call from Mr. Arvind from Derabassi outside Chandigarh who wants Rs. 1500 for visiting as a pre-condition besides other charges for parts. When I told him that Mr. Vinod had said Rs. 750, he refused to come and disconnected the call.

    6. Upon visiting Sawhney Fitness Equipments, phone number 82888-79466 of Dilip Kumar was given, who was non-committal on charges and date of visit and said that he will get instructions from his Mumbai company. When more details were desired, he openly rejected the request for repair and service and said he cannot provide any service.

    7. It is a matter of great regret that you are cheating and hoodwinking customers with attractive offers on your website but are not providing any after sales, service or repairs and leaving customers at the mercy of your agents or service providers to extract exorbitant charges from customers, who have no choice but to resort to blackmail.

    8. Your acts in offering attractive schemes on your website and online, without giving any aftersales repair or service facilities amounts to cheating under Section 420 IPC besides consumer offences under the Consumer Protection Act, 1986 of deficiency of service, malpractices, unfair trade monopolistic policies and depriving customers of service facilities.

    9. Please take notice that if you do not provide service facilities within 24 hours with proper servicing, I shall be constrained to take legal action against you under the Consumer Protection Act besides pursuing a case of cheating under the Indian Penal Code.

    10. I shall also be constrained to claim damages, compensation, costs and harassment charges from you.
